My Argos Card Mobile App Terms & Conditions


SUMMARY

The My Argos Card App ("the App") is an account management tool for Argos Card customers operated by Home Retail Group Card Services Limited. It allows you to make payments, check recent transactions, set certain account reminders and find out more about any credit plans that you have.

The App will also give you the opportunity from time to time to receive offers, deals and information relating to the benefits of your Argos Card (referred to as "Benefits"). By registering for the App you are agreeing that you want to receive these in-app Benefits.

The App will use push notifications to provide you with messaging about your account, new Benefits and from time to time direct you to a small survey about using your card. You can adjust which of these messages you want to receive via the App settings.

The App has been designed for operating systems on iPhone and mobile Android devices and it should only be downloaded from the Apple App Store for Apple devices or the Google Play store for Android devices. It may not function correctly on 'jailbroken' Apple devices, 'rooted' Android devices or older versions of these operating systems and on some tablets.

TERMS & CONDITIONS

The My Argos Card App is operated by Home Retail Group Card Services Limited registered in England with company number 4007072 (referred to as "we/our/us") which is part of Sainsbury's Group (referred to as "Group"). As a user of this App (referred to as "you/your") you agree to the terms and conditions set out below.

By registering for this App you agree to be legally bound by these terms and conditions and the Group Privacy Policy. If you do not accept these terms and conditions or the processing of your personal data in the Group Privacy Policy then you will not be able to use this App.

Please ensure that you read them in full before registering for the App for the first time. The Terms & Conditions will be available within the App at any time in the Settings section and the Group Privacy Policy is available anytime on our website.

WHO WE ARE

When we say 'we' or 'us' in this policy, we're referring to the separate and distinct legal entities that make up the Sainsbury's Group from time to time. Which of the Sainsbury's Group Companies controls your personal information depends on the circumstances in which you are dealing with us. For example, if you are dealing with one of our supermarkets, then it will be Sainsbury's Supermarkets Ltd, or if it is to do with your bank account with us then it will be Sainsbury's Bank plc.

The companies which make up the Sainsbury's Group currently are:

  • Nectar 360 Limited (registered office: 33 Holborn, London, United Kingdom, EC1N 2HT); and
  • Nectar 360 Services LLP (registered office: 33 Holborn, London, United Kingdom, EC1N 2HT)
  • We may add further companies to the Sainsbury's Group in the future. When we do so, we will update this notice to reflect that.

GENERAL

  • We can change these terms and conditions at any time by sending you an SMS or email with details of the change or notifying you of a change when you next start the App or log onto our website. The new terms may be displayed on-screen and you may be required to read and accept them to continue to use this App.
  • The information, services and products on this App are intended for use by residents of the UK only.
  • Only primary cardholders may register for the App.
  • The FAQs are not a communication tool and is not designed for customer interaction.

DATA PROTECTION

We will keep any information you have provided to us confidential. However, you agree that we may share this information with other companies within the Argos Sainsbury's Group and companies that provide services to us (as detailed in our Privacy Policy, which we may amend from time to time). Please see our Privacy Policy (found on our website HERE) for more details about how we and Argos Sainsbury's Group will use your information.

CONTACTING YOU

  • We retain the right to contact you:
    1. About your account where necessary.
    2. To administer our App services.
    3. For assessment and analysis (e.g. customer and product analysis).
    4. To administer any prize draws or competitions you may enter.
    5. To verify your identity where necessary.
    6. This App will use Push Notifications to contact you about your account, your available Benefits and any other information that we deem relevant or important to you. You can adjust the settings within this App to turn these Push Notifications on or off or to customise how often you want to receive Benefits. If you choose to turn off Push Notifications this will not alter any other marketing preferences you have for other Group contact channels, such as (but not limited to) email, post or SMS.

    DEVICE INFORMATION AND MOBILE DATA USAGE

    • For security reasons we reserve the right to restrict the number of devices on which you can register the App. If you need to deregister one of your devices so that you can download the App to another device then you can do so from within the App settings or you can contact Argos Card Services on 03456 400 700*.
    • By registering for this App you agree that we may use and store elements of your device data which are required for identification purposes, customer analysis and customer service. These elements include, but are not limited to, your frequently asked questions (FAQs), unique device identifier, your operating system details and firmware information, your mobile device model, your browser type, your device language settings and country.
    • We may from time to time make use of your device's location services unless you turn them off. By allowing us to use these services you are giving your consent to us and our partners to track and store information about your location which we may use to improve our customer analysis.
    • If you have location services switched on this will result in the App running in the background when you enter an Argos store.
    • This App may require the use of network data to function if Wi-Fi is unavailable. We shall not be responsible for the amount of data used when accessing or using this App, or for monitoring your data usage or any data roaming charges incurred as a result of using the App. Please check with your network provider for details of your data allowance and associated charges.
    • The amount of battery life that this App requires is dependent on how often you open the App, how long each App session lasts, the quality or age of the device you are using and your use of network data or Wi-Fi, and as such we shall not be responsible for battery usage while using this App.

    STORING YOUR DEBIT CARD CREDENTIALS FOR MAKING FUTURE PAYMENTS

    You can make a request to store your debit card payment credentials when you are making a payment towards your Argos Card on the App. If we accept your request to store your debit card payment credentials for making payments in future, then once the payment you are making is complete, we will confirm this to you together with appropriate details of your debit card number, on the App payment confirmation screen.

    These provisions apply where you have expressly requested us to store your debit card payment credentials on the App, so that you can make payments conveniently in the future towards your Argos Card. Taking account of VISA and Mastercard mandates for Stored Credential Transactions, the following provisions will apply to this arrangement:

    • We can only store the payment credentials for one of your debit cards. We cannot store the payment credentials of more than one debit card at any point in time. Also, we cannot store the payment credentials of any other type of payment card.
    • Your debit card payment credentials will be stored in a truncated way - i.e. the first six digits and last four digits of your card number together with the card expiry month and year. We will not store any other details of your card.
    • If you wish to store the details of a different debit card or if you receive a replacement debit card for the card whose details have already been stored ("new card") and wish to store the new card's details in place of the existing stored credentials, you need to expressly request us to store the details of your new card. You must make this request when you make a successful payment on the App towards your Argos Card using the new card. We will then overwrite the existing debit card payment credentials we have stored for you, with the credentials of your new card. The provisions of this App Terms & Conditions including this section of the App Terms & Conditions will then apply to the credentials we have stored of your new card.
    • The stored payment credentials are available for you to use on the App to make payments more easily. These stored credentials will only be used when payments are initiated by you and will be available to use only at the time you are making payments through the App. We will only use the stored payment credentials as and when you instruct us to make payments towards your Argos Card in this way. You will provide us with instructions for every transaction you make. When payments are initiated by you, the payment screen will only disclose the last four digits of your debit card number.
    • If we propose to make any changes to this section ("Storing your debit card credentials for making future payments") of the App Terms & Conditions, in future, we will inform you of these changes in accordance with the section headed "CHANGES TO THESE TERMS AND CONDITIONS" in these App Terms and Conditions.
    • This arrangement relating to your stored debit card credentials will come to an end if you inform us at any time that you wish to cancel this arrangement or if we inform you that we intend to cancel this arrangement. This arrangement will also end if your agreement relating to your Argos Card ends.
    • Where debit card details have been changed and replaced with the details of another card and also, following the end of this arrangement, we will need to continue holding the stored payment credentials relating to your card(s), for administrative and other purposes (including responding to any claims). We will only retain this information for as long as this is necessary, and it will be retained in accordance with the law and relevant regulations.
    • All transactions will be undertaken in pounds sterling.

    For the avoidance of any doubt, references to "we", "us" and "our" in this section headed "Storing your debit card credentials for making future payments" are to Home Retail Group Card Services Limited. For details of our address and phone number please refer to the Argos Card FAQs.

    USE OF COOKIES

    • The App uses cookies and similar technologies ("cookies"). Cookies are small pieces of information stored on your device to collect data about the way that you use the App and to improve your App experience. By using the App you accept our use of cookies as set out here.
    • We use a combination of persistent (long term) and session (short term) cookies to collect certain information in order to improve your experience of using the App. For example, this App will use a persistent cookie to remember your account ID so that you do not need to re-enter your card details every time you wish to use it, while it will use session cookies for your date of birth when you register which will be deleted when your session ends.
    • Some of our cookies will be used to collect information about your use of the App, such as how often you visit the Recent Transactions page or when an error message appears. This will help us improve the performance of the App and to make the App experience more relevant to you.

    INTELLECTUAL PROPERTY AND LICENCES

    • You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this App shall remain at all times vested in us or our licensors. You further acknowledge that any other use of the material and content of this App is strictly prohibited and you agree not to personally, or in any way assist or facilitate any third party, to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
    • The App is a piece of software which is free to download and your personal licence to use the App is given when you download it. You must not:
      • Sub-license the App to a third party
      • Copy, alter or reproduce any part of the App
      • Obtain or alter the source code of the App in any way.
      • Use the App in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the agreement or act fraudulently or maliciously for example by hacking into or inserting malicious code into the App or any of our operating systems
      • Upload, store or share inappropriate or illegal images or content that breaches the rights of others
      • Use the App in a way that could damage or compromise the Group systems or security or interfere with other users
      • Collect or harvest any information or data form our systems or attempt to decipher any transmission to or from the servers running the App

      Your licence ends when you delete the App or fail to comply with any of the terms and conditions listed here.

      LIABILITY AND INDEMNITY

      • If something goes wrong, we will be responsible to you as set out in the Argos Card Terms and Conditions. They explain when you will be able to claim back from us if you incur a loss or damage because of something we have done or not done.
      • Unless we are at fault, we will not be liable to you for any losses you suffer or costs you incur because:
        • you are unable to access or use the App for any reason or there is a delay in its use;
        • any device, hardware or software you use in connection with the App is damaged or corrupted or fails to work;
        • the App does not work as you expect, does not meet your requirements or contains errors or defects or we fail to correct these;
        • you did not receive any SMS notifications in a timely manner; or
        • there is a reduced level or failure to provide any service caused by any third party service providers including software providers and mobile operators.
        • Nothing in these terms and conditions will reduce your statutory rights including your rights relating to mis-described accounts or services and the fairness of terms. For further information about your statutory rights contact your local authority Trading Standards Department, the Competition and Markets Authority or the Citizens Advice Bureau.

        SECURITY

        • You must keep your mobile device secure and close the App if you are not using it. The conditions relating to payment instruments set out in your Argos Card Terms and Conditions apply in relation to the App.
        • If you suspect that someone else knows your passcode or other security details you must change your details where possible or contact Argos Card Services as soon as possible.
        • After your initial registration we will never contact you to request your security details and we will not ask anyone else to do so on our behalf. If you receive such a request then it is likely to be fraudulent and you must not supply your security details in any circumstances. You should report any such activity to us immediately.
        • You must ensure that your account details and other information you provide are correct and up to date and notify us as soon as these change.
        • If you chose to use Touch ID or Fingerprint login to log in to the App, you must ensure you only register your own fingerprints (and not anyone else's). You agree that any fingerprint stored in your device can be used to log in and use all features of the App, including making payments. You are responsible for the use of the App by any fingerprint stored in your device, including any use which breaches these terms and conditions. We will treat all payments from your account by any fingerprint registered in your device as if you have made them.

        CHANGES TO THESE TERMS AND CONDITIONS

        • We can change these terms and conditions at any time by sending you an SMS or email with details of the change or notifying you of a change when you next start the App or log in to our website. The new terms may be displayed on-screen and you may be required to read and accept them to continue to use this App.
        • From time to time updates to the App or your operating system may be issued via the Apple App Store for Apple devices or Google Play for Android devices. Depending on the update, you may not be able to use the App until you have downloaded the latest version of the App or operating system and accepted any new terms. It is your responsibility to check for updates and to keep the App or operating system up to date. We shall not be held responsible for any problems in the App relating to a failure on your part to update either the App or your operating system to the latest version.

        MISCELLANEOUS

        • The terms and conditions of use of this App are governed by the laws of England and any dispute will be resolved exclusively in the courts of England.
        • We may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that we are not responsible for the availability and content of such external sites or resources, and do not review or endorse such websites.
        • We work with a number of partners in the administration and running of this App. These partners do not have permission to use any of your personal information to contact you.
